Environmental Legality and Sustainable Development of Tourism

回顾了20年来中国旅游产业的发展,指出中国旅游已发展成重要的经济—文化产业。分析了旅游产业快速发展所引发的某些旅游设施水平定位和选择欠妥,不顾旅游景点环境容量而片面追求门票收入,旅游资源开发中环境影响评价环节薄弱,以及旅游景区之间的规划、建设、管理水平相差悬殊等诸多资源环境问题。针对上述问题及其产生的原因,探讨了如何完善环境法制,明确旅游产业的基本属性,在旅游资源开发中依法加强环境影响评价和环境保护,依法加强景区管理,以促进中国旅游产业可持续发展等法律措施。

Review the development of tourism in China in recent 20 years, which has become an important economic and cultural business. However, the rapid development of tourism has caused some problems, such as the improper choice of scenic spots and their facilities, aiming at 'income first' regardless of the possible capacity of scenic spots planned, the huge impact of developing tour resources on environment and various deficiencies in planning construction and management of tourism. An exploration is thus made on how to perfect environmental legality and clarify the basic attribute of tourism, especially on how to evaluate legally the damage to environment due to limitless development of tourism and strengthen environment protection via high-level management of scenic spots, with the intention of the sustainable development of tourism in China.
