论我国刑法的少数民族性

On Minorities' Characteristic in the Criminal Law of China

刑法是多民族文化的产物,应当体现作为中华民族构成内容的少数民族的民族文化,同时,少数民族性实质上是我国现有民族政策、国际种族有关规定内容在我国刑法中的体现。目前,刑法的少数民族性可以表述为:对民族文化的尊重、保护与法制统一性的要求。

Criminal law is the product of multinational culture. Minorities, as an important component of Chinese people, their culture should also be embodied in the criminal law. Meanwhile, minorities' characteristic in essence is an embodiment of our existing policy towards minorities and international racial regulations in the criminal law of our country. Presently, minorities' characteristic in the criminal law of China may be expressed as: respecting and protecting culture of minorities under unified legal system.
