On Basic Approaches to Economic Law

本文通过对有关法学方法论研究的反思,认为最能体现法律部门特性的方法论范畴有两对,即个体主义与整体主义、冲突辩证与和谐辩证。而从经济法产生背景和制度特征以及所取得的理论共识来看,最能体现经济法部门特性的方法论范畴有两个,即整体主义与和谐辩证法。

Studies of the methodology of law shows that there are two pairs of methodology categories which embody the characteristics of legal departments-individualism and collectivism, and conflict dialectics and harmonious dialectics while from the perspective of the background against which economic law develops, the characteristics of the system and the reached agreement with it, there are two methodology categories which embody the characteristics of legal departments-collectivism and harmonious dialectics.
