中日行政管理的现实及对能动行政的不同理解,导致两国对行政指导的概念及构成问题的认知差异。客观解读中日行政指导制度的效能,立足中国行政指导现状,坚持能动的法治观,探寻中国行政指导制度的内外支点成为谋求中国行政指导制度健康发展的可行路径。构建中国行政指导制度,应明确行政指导制度构建的指导思想与原则,加强行政指导的法治化、规范化和制度化建设,将培育行政指导发展的外部环境建设纳入行政指导制度建设轨道。

The different understandings of the reality of administrative management and the recognition of active administration cause different recognitions in terms of the concept and composition of administrative guidance between China and Japan. It is necessary to have a subjective understanding of the efficiency of the administrative guidance system, to have a realistic observance of the current situation in China and to insist on an active legislative attitude to better develop the administrative guidance system. In addition, it is necessary to clarify the theories and principles in establishing the administrative guidance system, as well as to enhance the establishment of relevant laws, regulations and rules.
