摘要
新修订的《工会法》赋予了工会组织依法申请工会经费的权利,但该权利的享有能否达到工会组织申请支付令的主观目的,应冷静分析。从督促程序的立法规定及《工会法》对申请支付令的具体规定出发,分析了工会申请经费支付令的条件及局限性,并提出了解决问题的初步设想。
The newly revised trade union law has given the trade union the right to legally apply for trade (union) funds. It still needs further consideration whether it can reach its subjective goal or not. This paper makes an analysis of its situations and limitations and puts forward some tentative ideas.
