论我国野生动物资源的刑法保护

On Wild Animals Protection by Criminal Laws in China

刑法介入野生动物资源保护非常必要。我国刑法在野生动物资源保护方面存在立法缺陷,针对这些缺陷,应该扩大野生动物资源法律保护的范围;修改并完善野生动物保护法有关刑事责任的条款,使之与刑法相衔接;增设"破坏环境资源保护罪"专章,并在其中设置"破坏野生动物资源罪"专节,将直接针对野生动物的犯罪纳入其中;增设"故意伤害、虐待珍贵、濒危野生动物罪"和"点食、购买、出售野生动物菜肴罪",以期充分发挥刑法的作用,更好地保护我国的野生动物资源。

This article discusses the necessity of protection of wild animals from the legal point of view. After a simple introduction to and a brief analysis of the lawmaking development of crimes of destroying resources of wile animals, and of its legal limitations, we, aim at avoiding these limitations, tentatively bring forward the following proposals: extending legal conservation of wild animals, amending and consummating items of criminal liability of protecting wildlife, and thereby bring it into the criminal law. A separate chapter of crime of destroying environmental resources is to be added and a special section of crime of destroying wildlife is to be set up, in which crimes about directly destroying wildlife are included, such as crime of purposely injuring and maltreating the rare and endangered wild animals, crime of ordering and eating, purchasing and selling of wild animals as food. All the above considerations aim at properly protecting wild animals in China through the exertion of criminal law.
