精神损害赔偿权利主体限于公民。不包括法人。死者具有人格法益，法益受到侵害可以诉请精神损害赔偿，诉权由其近亲属行使。

Subjects of right in mental compensation are citizens,excluding juridical persons.Deceased persons own legal interests and their close relatives can exercise rights of action for mental compensation when their legal interests are infringed.
