摘要
本文在分析已有材料的基础上 ,提出了量刑情节的概念 ,简述了量刑情节的功能 ;就量刑情节的分类问题 ,指出某些主张的不当之处 ;认为某些事实在同一案件中先后作为定罪情节和量刑情节使用 ,不是重复评价。
The author proposes the concept of circumstances in discretion of punishment; criticizes some views on the classification of circumstances in discretion of punishment; some facts are to function both in conviction and in discretion of punishment.
