近代以来,工业化导致的环境污染给过错责任带来严峻的挑战,基于公平救济的需要,过错责任理论终于被超越,无过错责任在环境侵权损害领域得以确立。然而,随着经济社会的不断发展,现代公平理念对无过错责任提出了更高的要求。我国环境侵权立法应适应经济社会现代化的需要,不断加以完善。

Since modern times, the environmental pollution caused by industrialization has brought severe challenge to fault liability. Based on the need of fair relief, the liability without fault has been established in the field of damages caused by environmental infringement, with the theory of fault liability surpassed finally. However, with the steady development of economy, the idea of modern fairness has brought forward higher requirements to liability without fault. The legislation on environmental infringement in our country should be adapted to the need of modernization of economic society and be kept improving constantly.
