摘要
文章以南美洲、非洲和亚洲一些国家为例 ,介绍了与探矿权和采矿权有关的主要法律规定 ,总结了二者之间的过渡关系 ,主要有三种 :探矿权人自动取得采矿权、探矿权人有采矿优先权以及由政府自由裁量。在此基础上又从取得机制和取得方式两个方面展开 ,进一步论述了矿权的取得制度。
Taking the examples from the countries of South America, Africa and Asia, the paper give us an introduction of main laws and regulations related to mineral prospecting right and mineral exploitation right and has summarized conversion relations between mineral prospecting right and mineral exploitation right. They have three kinds of relations mainly. Prospectors automatically obtain the mineral exploitation right, prospectors enjoy the priority of obtaining the mineral exploitation right and government arbitrarily makes decision. Then the paper discusses further the obtaining system of mining rights from the angle of obtaining mechanism and means.
