对我国建立亲权制度的探讨

An Approach to Establishing Parent Right System

亲权作为保护未成年子女权益的一项民事法律制度,被一些大陆法系国家立法所确立。是否在我国立法中明确建立亲权制度,立法与实务中存在诸多争议。文章论述了将二者分开,建立亲权制度的必要性,并对我国亲权制度的立法体例作了构想。

Parent right, as a civil law system of protecting miner offsprings' rights, has been legislated by some continental countries under the rule of law. There exist many controversies in legislation and concrete cases whether parent right system should be established in China's legislation. The paper expounded the necessity of establishing parent right system and had an idea for legislation style of parent right system in China.
