人格权问题之检讨与矫正

随着经济的发展及中国加入世贸组织后 ,原来民法通则关于人格权的规定已经不能适应时代发展的需要 ,笔者对现行民法关于人格权规定进行检讨 ,指出完善人格权制度的必要性 ,并结合时代发展 ,特别是十六大“人权入宪”的时代条件 ,重新对人格权法 (草案 )作出检讨 ,并提出矫正措施。
