论民事诉讼公正与效率的矛盾与协调

公正是国际普遍公认的一项司法原则,效率也是各国所追求的诉讼价值。民事诉讼公正与效率存 在着矛盾,即它们之间是对立统一的关系。我们在协调两者关系时应该做到公正优先兼顾效率。笔者探索了我国 民事诉讼价值协调机制的构建。

Justice is judicial principle of international universally generally acknowledged . The efficiency also is the lawsuit value that was sought by each country. There exists contradiction between the civil lawsuit and the civil efficiency, and between them is the relation of unity of opposites . We should accomplish the justice prior the efficiency giving consideration to many things when coordinating both relations . The author has explored how to construct the civil lawsuit value coordination mechanism in our country.
