摘要
人大是否有权或应当对法院进行个案监督,是一个争议较大的问题。司法是一种由第三方独立地、中立地裁判争议的行为。独立、中立、被动是司法的特性。从本质上讲,司法是判断,是一种认识。它必须是由经过严格法律专业训练的人,按严格的法律程序才能进行的一种工作。因此,从司法的性质讲,权力机关不应当对法院进行个案监督,而应当在宪法和法律的范围内,立足宇宏观的、一般的、事后的监督。
There is a heated dispute about whether National People's Congress has the right or should exercise supervision over a particular case. Administration of justice is an act which the third party takes independently and impartially. In this connection administration of justice is judgment and knowledge in some sense, which should be enforced by professional person with rigorous training, according to strict legal procedure. So the People's Congress should exercise a macroscopic, comprehensive and follow-up supervision instead of over a particular case.
