Study on the System of Independent Guarantee

独立担保是一种新型担保方式,与传统从属担保有重大区别,但我国现行法律没做明确规定。本文对独立担保的历史发展、概念与特征、独立担保合同的类型作了探讨,同时对建立我国独立担保制度的必要性进行了论述。

Independent guarantee is a new pattern of guarantee. It has a significant difference with the traditional dependent guarantee. But the law of our country in force does not stipulate definitely. This article explores the historical development, concept, characteristics and contract type of independent guarantee. It also discusses the necessity of establishing the independent guarantee system in our country.
