群体性上访事件调查取证之难点分析

An Analysis of the Difficulties in the Events Related to People Appealing for Help in Groups during the Process of Investigation and Evidence Collection

目前 ,公安机关在群体性上访事件的调查取证中 ,在法律依据、取证意识、取证对象、取证重点、取证途径、取证时机、取证的方式方法等方面面临着诸多难题。为了做好群体性上访事件的调查取证工作 ,公安机关要从违法上访行为的行为主体、主观方面、客观方面等构成要件上明确取证对象 ,通过多条渠道拓宽取证途径 ,掌握最佳的取证时机 ,注意调查取证的方式方法 。

In the present practice of investigation and evidence collection against events related to people appealing for help in groups, public security organs face quite a lot of problems as to legal basis, awareness, object, emphasis, approaches, timing, and methods of evidence collection. To investigate and collect evidence against such cases, public security organs have to stress the following processes:1) to make clear the evidence-collecting object from the aspects of main part of behavior, subject, object and so on;2) to widen the evidence source;3) to grasp the best opportunity of evidence collecting;4) to further develop the methods of collecting evidence;5) to balance the relationship between open evidence collection and secret evidence collection.
