摘要
我国劳动教养制度形成于特殊历史时期,原是以非常手段解决特殊历史时期的阶级斗争、社会治安、劳动就业以及意识形态问题的权宜之计,后来逐渐演变为执政党及行政机关推行政治、行政强权的工具。剖析劳动教养制度的历史成因,揭示现行劳动教养制度同我国第四次宪法修正案人权条款的根本对立、同我国现阶段政治文明与法治进程的严重背离以及由此产生的尖锐矛盾,有助于我们正确评价现行劳动教养制度,并就其存废作出正确选择。
China's reform system through labor used to be an expediency to classstruggle,social security,employment and ideology during that special historical period;and later it turned into the political and administrative instrument of the government. The analysis of the historical background of the existing reform system reveals its confrontation with the human rights clause in the constitution(the 4~th amendment) and its deviation from the existing political civilization and the process of China's administration according to the law.And the poignant contradictions thus incurred.Moreover,the analysis helps us peach a better understanding and evaluation of the existing reform system and make an alternative choice whether to keep it or abolish it.
