International Project Contractor’s Strategy Against Risk of Force Majuere and Its Practice

国际工程承包商必须重视对“不可抗力”风险的研究与应对,避免因承揽项目心切而盲目让步,最终承担本该由业主承担的“不可抗力”风险。在应对“不可抗力”风险的过程中,签好合同是前提,风险管理是基础,积极索赔是关键,适当保险是保障。发生“不可抗力”风险的同时也伴有创收机遇,我国承包商要善于发挥优势,创造有利条件。

To avoid conceding blindly and undertaking the risk of “Force Majuere”, international project contractors should value the research on risk of “Force Majuere” and its application. In dealing with the potential risk, there are four points to remember: signing contract is a premise, risk management is a foundation, claiming positively is a key, and appropriate insurance is a guarantee. The occurrence of risk is always accompanied with opportunity of gain. Chinese contractors should make full use of their advantages, create beneficial surroundings and convert risk into economic benefit.
