摘要
长期以来我国民办学校的产权归属问题缺乏明确的法律规制 ,影响了民间资本的投资保障和教育的健康发展。明晰民办学校的产权归属问题必须坚持教育的公益性和可持续发展原则 ,同时承认投资资本寻利倾向的客观性 ,贯彻风险和利益并存原则。要借鉴国外或地区私立学校成熟立法例 ,尽快建立产权关系清晰、资产归属明确、权义相互一致的民办学校产权制度 。
Due to lacking of definite law rules to regulate for a long time,the property rights of private schools in China affects the guarantee of capital investment and the healthy development of education.In order to draw a clear line of this matter. We must insist on public oriented principles of education and sustainable development principle. At the same time, it is necessary to confirm the objectivity of capital benefit and carry out the principle that risks coexist with the benefits.We should draw upon both abroad and regional private schools’ successful experience on law making and establish our law rules system which contains the clear and definite property rights and right duty consistence orders as soon as possible to promote the healthy development of private education in China.
