在国有独资和控股公司建立职工董事、监事制度 ,应以现行法律法规为依据 ,依法确立工人阶级和职工董事、监事的法律地位 ,分清规范和制约职工董事、监事行为的不同法律关系 ,在现行法律的框架内 ,通过制定、修改和完善公司章程等规章制度的办法 ,积极寻求和探索建立职工董事、监事法律制度的有效途径。
