打赢高技术战争的战争法思考

Pondering on Issues of the Law of War under Condition of High-tech War

高技术战争有脱离现有战争法的可能 ,但不会完全摆脱战争法的调控 ,战争法将在高技术战争与现有战争法的矛盾斗争中谋求发展。因此 ,在我国的军事斗争准备中 ,必须克服战争法虚无主义和迷信战争法的思想 ,正确看待战争法的作用。在积极参与战争法创制的同时 ,还要认真进行军事准备。在战争中也要抓住有利时机 ,依据战争法展开政治上的揭露、军事上的报复、战争犯罪的国内惩治 ,争取战争的主动地位。

The high-tech war may break away the regulation of the existed law of war, but it can absolutely shake off the control of the law of war. The law of war will develop in the conflict between the high-tech war and the existed law of war. Therefore, in the military preparation, we should look on the role of law rightly instead of boasting the views of the law of war is nothing or is everything. While we positively enact the laws of war, we should operate the military preparation properly. During the war, we should catch hold of the favorable time to take the political disclosure, the military revenge and the domestic punishment of the war criminal offence according to the law of war so as to get the positive position of war.
