On the Guarantee Under the Debt Ceiling

本文从最高额保证的特点、最高额保证的担保责任范围、最高额保证期间和最高额保证的保证人单方终止权等四个方面 ,对《担保法》规定的最高额保证进行了理论上的探讨。本文的核心在于对最高额保证与普通保证的区别、最高额保证的责任范围、最高额保证合同期间与保证期间的区别和保证人单方终止最高保证合同的要件等在民商法学界有争议的问题和理论进行整理和批判 ,以期完善最高额保证的理论研究 ,并对《担保法》

This paper makes a theoretical study on guarantee under the debt ceiling which is regularized by The Law of Guarantee from four perspectives such as the features of guarantee under the debt ceiling、the scope of duty of guarantee under the debt ceiling、period of guarantee under the debt ceiling and guarantor's right of one sided termination. The paper focuses on such problems as the difference between guarantee under the debt ceiling and general guarantee、the difference between period of contract of guarantee under debt ceiling and period of guarantee under debt ceiling、the scope of duty of guarantee under debt ceiling and the guarantor's right of one sided termination so as to carry on some analysis and review on the problems with an aim of perfecting the theory of the guarantee under the debt ceiling and producing some influence on The Law of Guarantee in the respect of the guarantee under the debt ceiling.
