Administrating according to Law: the Core in Running State Affairs According to Law

依法行政是人民群众联系最广泛、最经常、最密切、最直接且存在问题最多的环节 ,因此也是依法治国的核心环节。改善依法行政及监督机制的对策在于 :改善法律制定工作的指导思想 ,保证依法行政与民主行政 ;以落实行政处罚法、立法法为契机 ,贯彻依法治国战略方针 ,实行“法治行政” ;转变政府职能 ,清理法规、规章 ,改革执法体制 ;推行行政执法责任制 ,解决职责交叉重叠、越权执法、推诿和执法不到位等问题 ,划清各执法部门的职责 ,明确各自的执法任务 ,使执法与经济利益脱钩 ,保证执法大公无私 ;大力普及法律知识 ,增强全民法制观念 ;强化监督机制 ,对监督者实行地位高、权力大、独立办案 ,排除外来干扰 ,加强各级人大对行政执法工作的监督。

Administrating according to law is the core in the running of state affairs according to law. The countermeasures to improve administration according to law and supervisory mechanism include: (1) bettering the guiding mentality for the formulation of laws to ensure administrating according to law and democracy; (2) reinforcing the strategic policy for running state affairs according to law, at a time when the penalty law and legislation law are effected; (3) transforming governments functions, liquidating rules of law, regulations and reforming mechanism for executing the law; (4) putting into effect liability for executing the law to avoid obliquity, superposition, buckpassing, etc.; (5) popularizing and emphasizing notions and concepts of law and intensifying supervisory mechanism and in particular, the supervision by peoples congress at all levels over the execution of law.
