网络犯罪的法律对策存在犯罪证据认定、法律适用、司法管辖等方面的局限 ;其教育对策旨在做好人的工作 ,在思想上建立起屏障 ,体现为一种内化控制、事前控制、主动控制的新思路。网络犯罪的教育对策的重点是道德约束 ,使人们从内心形成道德情感、道德良心和道德信念 。

The limitations on confirming criminal evidences, law application, judicial jurisdiction exist in the law countermeasure to network crime. The goal of instructive countermeasure is to build up a protective defence in people's mind, which reflects a new idea of 'inner control', 'advanced vontrol' and'initiative control'. The key point of the instructive countermeasure to network crime is moral restraint, which make people form moral feeling, moral conscience and moral faith from their hearts,so that transgression and crime can weaken naturally in the body of society.
