摘要
我国《刑法》第 1 3 5条规定了重大劳动安全事故罪。该罪的确立充分体现了刑法维护职业安全、保障劳动权的立法精神。重大劳动安全事故罪在性质上是单位犯罪 ;是违反劳动法、侵犯劳动权的犯罪 ;是过失犯罪。重大劳动安全事故罪的立法规定不尽合理 ,应该予以完善。
Offense of major labor security accent is provided by article 135 of the Criminal law of the People's Republic of China 1997.The establishment of the crime reflects the legislative gist of the criminal law which is to uphold job-security and to ensure right to work.The nature of offense of major labor security accent is unit crime and unpremeditated crime.It's also a kind of crime which violates labor law and infringes right to work.The legislation of this kind of crime is still not reasonable completely now.It's needed to be consummated gradually.
