论检察机关对刑事审判的监督

On the Prosecutorial Supervision over Criminal Justice

对刑事审判进行监督是我国检察机关的一项重要职能 ,这种监督不会动摇法官的中立地位 ,不与检察机关的刑事追诉职能相矛盾。应通过强化对审判程序的监督和限制对不利于被告人的生效裁决的抗诉等方式完善检察机关的刑事审判监督职能。

Supervising over criminal justice is one of the most important functions of the procuratorial organ in our country,such function won't threat the neutral status of judges,nor does it contradict to the criminally persecutrive function of the procuratorial organ.We should strengthen the supervision over judicial procedure and limit counterappeals against the operative decrees which throw the deffendants at a disadvantage to improve the procuratorial organs' function of supervising over criminal justice.
