治安调解实践的几个疑难问题浅析

Superficial Analysis about several Knotty Problems in Security Conciliation Practice

公安机关在进行治安调解时,有以下问题应明确:治安调解无论是否达成协议,都应当有调解笔录或治安调解书;治安调解中的“告知”应当履行告知程序;民间纠纷与民事纠纷是两个不同的概念,公民与法人之间、法人与法人之间因民事纠纷引起的打架斗殴或者损毁他人财物等违反治安管理行为,情节轻微的,公安机关不能调解处理;因民间纠纷引起的殴打他人或者打架斗殴,只造成一方有轻微伤害的违反治安管理行为,情节轻微的,公安机关不能调解处理。

In the security conciliation of the public security organs,the following problems should be clear;1) whether the security conciliation comes to an agreement or not, there are conciliation records or security conciliation agreement;2) the informing proceedings should be performed in the 'informing' of security conciliation;3) popular dispute and civil dispute are two different concepts, if the circumstances of the case is not serious,conductiong in violation of security administration, such as fighting or causing injury damages for others between the citizen and the legal body or among legal bodies can't be concili-ated;4) if one part has minor injury and no serious circumstances, the public security organs can't con-ciliate the case.
