流动人口计划生育管理法规模式研究

由于我国现阶段计划生育法及相关地方性法规对农村流入城市打工或经商人员的计划生育管理出现漏洞,导致了许多流动人口非法生育的现象。对此提出了建立健全流动人口计划生育属地化管理法规的模式,对流动人口的计生管理统一由其暂住地的计生部门行使管辖权,其它部门配合计生部门工作的模式。该模式解决了以往由其户籍所在地管理存在的矛盾,可以杜绝非法生育的发生,有效遏制我国流动人口的不正常增长。

There are not few people who are not planned parenthood, because the leak and malpractice of the management of family planning of moving population. This paper puts forward a legislation idea about the principle of the dependent local authorities network management of family planning. It is the perfect and complement the law of population and family planning in China. It also fills up the vacancy of legislation about family planning of moving population.
