摘要
在法律全球化的影响之下,中国传统法律文化面临着"文化失语"的尴尬处境。在法律全球化背景下探讨中国传统法律文化的定位问题,也就是探讨全球化与本土化的关系问题,中国法治发展中的建构论和进化论之争实际上也就是源于全球化和本土化之争。在法律全球化的背景中,我们要努力挖掘传统文化中的法治因子,实现中国传统的创造性转化。
Due to the influence of the legal globalization, the traditional legal culture in china faces an awkward situation of 'cultural aphasia'. Studying the orientation of traditional legal culture against the background of legal globalization is to study the relations between globalization and localization. The debate between construction and evolution derives from the debate between globalization and localization. Against the background of legal globalization, we should complete the creative transformation of Chinese tradition by studying the gene of law rule in our traditional culture.
