从传染性非典型肺炎防治谈强制医疗关系

On compulsory medical relation through the prevention and treatment of SARS

2002年底以来,广东及全国其他城市先后发生了传染性非典型肺炎(SARS)。为控制SARS的流行,确保大众的健康,卫生部将SARS列入法定传染病进行管理,对SARS病例和疑似病例以及密切接触者采取强制诊疗或检查等措施,遵从强制医疗关系,实行强制性医疗制度,使抗击SARS取得了阶段性的胜利。本文从医患法律关系的角度,探讨了强制医疗关系的概念、强制医疗关系与医患合同关系和医患无因管理关系的区别与联系,分析了强制医疗关系给医患双方带来的利弊,并对强制医疗关系的适用规范进行了进一步探索。指出了强制医疗关系在抗击SARS和保障人民健康中所发挥的重大作用。

SARS has successively occurred in Guangdong and other cities and regions of China since the end of 2002.Through describing the occurrence of SARS, compulsory isolated treatment of SARS cases, uncertain cases and contact people and victory over SARS, from the point of view of doctr-patient legal relation, the paper discusses the conception of compulsory medical relation, the differences and relationship between compulsory medical relation and doctor-patient contract relation of voluntary service. The paper also analyses the advantages and disad- vantages which compulsory medical relation bring to doctors and patients.At last, the paper points out that compulsory medical relation play a important role in oppugning SARS and ensuring people’s health.
