中西著作权刑法保护的比较研究——兼谈我国侵犯著作权犯罪的立法完善

Comparative Study of Copyright Protection in Chinese and Western Criminal Law——Concurrently Talk about Legislative Perfection on the Infringement of Copyright in Our Country

从著作权刑法保护的价值基础、侵犯著作权犯罪客体、客观方面、主体、主观方面等角度对中西著作权刑法保护的现状进行了分析,认为我国著作权刑法保护应当结合我国具体实践借鉴西方国家立法进行完善,但不应盲从于西方。

By comparing the status quo of copyright protection in Chinese and Western criminal law from the angles of value foundation,object,external aspect,subjective aspect,and infringer,the author believes that copyright protection in our criminal law has to be perfected by integrating with specific practice in our country and drawing lessons from legislation of Western countries instead of following the West blindly.
