对软件侵权鉴定中的源程序作用的认识

The Cognition of Source Program in Software Infringement Appraisal

源程序是软件开发者身份的重要证明,在软件著作权的纠纷中,如果当事人不能出示源程序,有可能因举证不能而导致承担法律责任。但是,源程序并不是开发者身份的唯一证明,软件开发过程中的一切原始材料,均可作为软件作者的开发证明。另外在软件侵权的鉴定中,不能以程序不完全相同而简单地否定抄袭可能性的存在。

Source program is an important proof of status for software developing person. In software copyright dispute if the litigant did not show the source program, it is possible that the litigant has to hold legal responsible due to evidence lack. But the source program is not the only proof for the software developing person. All original material will be the status proof. Though the program is not all the same, it is not impossible to have plagiarism in software infringement appraisal.
