Some Issues about the Judgment of the Crime of Accepting Bribe

斡旋受贿中的“利用本人职权或者地位形成的便利条件”,是指受贿人利用自己职务与其他国家工作人员职务的可交换关系;受贿罪中的“不正当利益”应当包括违反法律、法规、国家政策和国务院各部门规章规定的利益和通过行贿手段获得的不确定的、竞争性的利益;国家工作人员离退休后不能成为受贿罪的主体。

The term “taking advantages of personal power or position” in indirect bribe acceptance means making use of the convertible relationships between one’s own post and the post of other government staff. The term “unjust enrichment” should include the interests against laws, regulations, government policies and other regulations made by the State Council and the incorrect and competitive interests obtained through accepting bribes. The retired government staff cannot become the subject of the crime of accepting bribes.
