构筑立体式的证明标准结构——对我国刑事诉讼证明标准的思考

Solid standard of proof—Reconstruction of standard of proof in China's criminal procedural Law

对传统意义上我国刑事诉讼客观真实的证明标准,进行理论和实践上的分析,指出引进法律真实证明标准的必要性。在借鉴西方发达国家“排除合理怀疑”的证明标准的基础上,意在构筑一种立体的,多元的证明标准结构。

This article is an introduction to the standard of proof toward legal truth in criminal procedural law through an analysis of conventional standard of proof toward objective truth in China.In view of the“beyond rea- sonable doubt”standard in the western countries,a type of solid and diverse standard of proof is expected to be bulit to achieve the goal of procedural justice.
