公用企业滥用垄断地位成因及对策

On the Reasons and Solutions of Abuse of Monopolization of Public Company

本文对“公用企业”的概念加以法律界定,对公用企业形成垄断传统的原因及易于滥用其垄断地位加以阐释,并提出相应对策:其一,改革公用企业的政府管理体制,实行真正的政企分离;其二,导入竞争机制,实行分业经营;其三,规范企业的竞争行为,实行合理的价格管制;其四,建立有利于消费者的诉讼机制。

This essay defines the concept of“public company”, explaining the reasons to the form and the tendency of abuse of monopolization. The article holds that: first, reform the governmental management system of “public company”to carry out the real division of government and enterprise; second, introduce the competition and put the division of businesses into effect; third, standardize the competition of the enterprises and implement the reasonable price restrictions; fourth, set up the legal proceedings that are beneficial to consumers.
