越界建筑侵入他人建筑物上空之法律问题研究

A legal study on buildings trespassing the space over other’s buildings

土地使用权人所建建筑物上空的空间权利是一种空中权,可以分为建筑物上空空间所有权和建筑物上空空间利用权。建筑物上空空间所有权的主体是国家和集体,建筑物上空空间利用权的权利范围以土地使用权人所报建建筑物顶部高度为其权利下限。对越界建筑侵入他人建筑物上空的法律问题提出解决办法。

This paper thoroughly analyzes the legal character of the space over the buildings of the land users in China and comes to a viewpoint that the legal rights owned by the land users is a kind of air rights. And the air rights include the legal rights of owning the space over the buildings and the legal rights of utilizing the space over the buildings. The nation and the collective is the owner of the space over buildings and the land users own the legal rights of using the space under the top of the submitted height of the buildings.
