论我国侦查程序中检警关系的优化——以制度的功能分析为中心

On the Optimization of Prosecution-Police Relation in Procedure of Investigation——with Focus on Functional Analysis of System

评判侦查程序中检警关系构建是否合理的标准应该为能否实现侦查程序本身的运作目的,因此本文将侦查程序的目的划分为三个层次并以此来设定侦查程序中理想的检警关系所应该具备的功能,通过参照此种目标制度的功能设定,本文指出了我国现行检警关系所导致的侦查程序功能瑕疵并据此提出了优化我国侦查程序中检警关系的具体方案。

The criterion for rationality of prosecution-police relation in procedure of investigation shall be whether this relation help realize the essential purpose of the procedure of investigation.Therefore this article divides the purpose of procedure of in- vestigation into three levels by which the expected function of an ideal prosecution—police relation in procedure of investigation could be established.With reference to this functional prescription of this object system,this article presents a detailed project to optimize the prosecution-police relation in procedure of investigation after has indicated functional defects in procedure of investi- gation causing by current prosecution-police relation.
