摘要
《摩奴法典》是古印度后吠陀时期权威性的法典①,它是古印度社会历史沉淀的产物。从《摩奴法典》的婚姻家庭法中折射出的古印度法文化代表着这一时期法文化的共同特征。以法典的婚姻家庭法为视角,对这一时期古印度的法文化的特点以及各特点的形成原因、表现和社会影响作一分析。
The law of marriage and family is the key content of MANAVA-DHARMA-SASTRA-LOIS DE MANOU which is one of authoritative code of the later VEDA era .The law of marriage and family has taken on the religious、unequal、primitive 、relative tolerant、advanced 、ideal and philosophical dialectic traits on itself, also included the traits of era and nation .From the angel of the law cultures to concretely analyzed the traits and reasons of which lead to the traits and the traits embodying of the law of marriage and family is the premise and grounds which we can correctly understand the law of the ancient India marriage and family and its social relationships.
