摘要
预告登记,是指在本登记前,通过限制登记名义人的处分权,以保全关于物权变动的请求权或其顺位的一种暂时登记在预售房屋领域,我国一直实行预售合同备案登记制度。在市场经济快速发展,商品房买卖不断增长的新形势下,预售商品房备案登记制度已成为制约我国房地产市场进一步成熟的制度障碍,以预告登记制度取代预售合同备案制度是大势所趋我国预售房产预告登记制度的完善,必须解决多重问题。
Advance registration is a temporary registration which claims to preserve the right request for the alteration of the right to property by restricting the registrant' s right to disposal in advance of the official registration. In the field of preselling real estate, the registration system of filing preselling contracts has been adopted for a long time in China. With the rapid development of market economy and the increasing growth of real estate business in China, the registration system of preselling contracts has become an obstacle to the improvement and maturity of real estate business. Therefore, it is a tendency to replace the registration system of filing preselling contracts by advance registration system. Priov to the perfection of advance registration system a series of problems should be solved.
