On the trend of the international protection of intellectual property in the 21st century

与高水平的知识产权的私权保护相比,TRIPS协议对于相关公共利益目标所给予的关注是不够的。多哈宣言确定了公共健康权优先于私人财产权,为发展中国家在双边或区域贸易协定中协商知识产权保护条款提供了重要的标准。多哈宣言第6段的执行是发展中国家成员和人类发展事业的一个胜利。以多哈会议为标志、以公共健康问题为契机,21世纪知识产权国际保护制度将向更理性的方向发展。

Compared with high-level protection of intellectual property as private right, TRIPS shows inadequate concern about public interests. The Doha Declaration put public health right before private property and set an important level for the developing members of the WTO. The implementation of paragraph 6 of the Doha Declaration is a triumph of the human cause for development and the developing members of the WTO. With the symbol of the Doha conference and the turning point of the public health issue, the international protection system of intellectual property will go more reasonably in the 21st century.
