Research on Civil Collegial System

本文开篇提出了合议制度作为四大基本制度之首被理论界质疑的现状,继而通过对合议制概念、内在机理的阐述,表明合议制的基本制度地位不应受到挑战。笔者介绍了各国审判组织方式的组成,分析了我国合议制度缺失的现状和原因,提出了如何完善合议制的建议与构想。

The article introduces the phenomenon that collegial system as the first basic system is challenged by academic circles. Then it expounds the concept and inherent mechanism of collegial system to indicate that collegial system can't be challenged. The article introduces trial organization of other countries and analyzes the disadvantages and reasons of our collegial system. At last it puts forward the suggestion and propesifion how to improve our collegial system.
