《国家赔偿法》违宪条款质疑

Call it into Questions that “the Articles of the Law of National Amends” Have Violated the Constitution

作为治理国家的基本手段和工具的法治,必须是善法之治。《国家赔偿法》作为我国现代社会法治进程的一项重要内容和基本制度,必须符合法治原则、宪法精神及国际法准则。然而,我国现行《国家赔偿法》的有关条款之规定却不乏违宪之处。为了保障宪法效力的至高性和权威性,维护我国法制建设的统一和尊严,实现宪政宗旨,充分而全面地保护公民、法人和其他组织的合法权益,推动廉政建设,促进依法治国,《国家赔偿法》的违宪条款应予以修订。

The law must be good because it is the basic method and means to govern the country in law. As an important content and basic rule in the development of our law, the law of National Amends should be in line with the principles of the rule of law, the spirit of constitution and the rule of international law. However, some rules of the current law of National Amends violate the constitution. In order to guarantee the supremacy and authority of constitution, uphold the unity and dignity of construction in legal system, bring about the aim of constitutional government, fully and wholly protect the citizen, corporation and other organizations' legal interests, push the construction of a clean government forward, promote running the country in law, some rules of violating constitution of the law of National Amends should be revised.
