The Right to Choice of Proceedings in Civil Procedure

程序选择权本质上属于程序人权,理论依据为程序人权保障理念、程序主体性原则及处分权主义,内容包括当事人对纠纷解决方式的选择权、对诉讼程序的选择权与对诉讼手段的选择权。程序选择权在民事诉讼中具有适应世界各国民事诉讼发展趋势、实现民事诉讼目的、降低诉讼成本,提高程序效益和实现司法公正等实践价值。在我国立法中,程序选择权没有得到充分体现,因此,应当借鉴国外立法经验,改革与完善我国现行立法;增设某些程序选择权;明确法官的阐明与告知义务;明确律师的正确建议义务。

The right to choice of proceedings, as an important procedural right of the parties in civil procedure, originates from such theories as the idea of human rights protection, the principle of procedure subject and principle of disposition. Legislation regarding the right to choice of proceedings in foreign countries is observed according to three aspects of the right. The right to choice of proceedings should reflect its values: adaptation to the global developing trend of civil procedure, fulfillment of the purpose of civil procedure, fulfillment of the purpose of civil procedure, increase in procedural benefit and achievement of judicial justics. China's present system of right to choice of proceedings needs to be reformed and perfected.
