新闻自由与人格权的冲突是当前社会新闻侵权案件的关键和实质,寻求这两种权利的平衡与协调,探索实践中可资借鉴的普遍标准,是理论和实践中解决相关新闻侵权案件的必要途径,也是完善我国新闻立法的前提条件。

The conflict between the right of personal personality and the freedom of press is the most significant reason for the infringement of the personal rights. Keeping the balance between these two fundermental rights and finding the most admitted standards in present administration of justice are the essential approach to handle the disputes and pave the way to establish the leagle system of press.
