Patent Law and Protection of Traditional Knowledge:A Chinese Perspective

摘要 传统知识与生物多样性是现代创新的重要源泉，如何保持并对这些传统资源进行可持续利用是发展中国家与发达国家共同面对的问题。而如何协调专利法与传统知识保护的关系则是传统知识保护中最为基本又最为重要的问题。从20世纪80年代开始，传统知识的重要性，以及增进、保存和保护传统知识的要求，在不同的国际论坛之中得到了越来越多的承认。许大发展中国家也开始采取措施对传统知识和生物多样性加以保护。
