论法官独立的制度机制

On Policy and Measure of Judiciary Independence

从现代司法的本质———司法程序的公正性、亲历性、依法性、自治性等方面的要求为出发点,论述了法官独立的必要性,分析了制约法官独立的诸如观念、体制等方面的因素,并就5个方面提出了相应的改革措施,以保障法官独立。

Based on the current judiciary essence, i.e., justice, self-experience, legality and self-governing, etc., the necessity of judiciary independence was discussed and analyzed. The factors affecting judiciary independence such as moral ideas or administrative system were analyzed and related countermeasures to guarantee judiciary independence were put forward.
