对我国市场经济秩序规范化的法律思考

在我国,市场机制已代替计划机制对资源的配置发挥着基础性作用,但市场机制并不完善,存在着市场主体不明确、产权规范、竞争规范、交易规范和行政管理规范等问题,其根源主要是市场失灵。而对市场失灵的纠正,传统的国家行政干预模式存在诸多问题,缺乏持续有效的约束力。要有效解决以上矛盾必须强化法治手段,弱化政策干预,构建一整套法律规范,建立和完善宏观调控法,依法管理,以期实现市场经济秩序的规范化。

In China, economy mechanism exerts the fundamental influence on the resource distribution in stead of planed economy. However, with a lot of problems, such as unclear market main parts, property norms competition norms,trade norms and administration norms, economy mechanism is not perfect mainly because the market is out of order As for the correction of the market malfunction,traditional administrative interfering patterns have many problems due to its lack of continuous and effective constraining force.In order to solve above conflicts, laws must be intensified; the administrative interference must be weakened; a series of legal standards must be planed ;management must rely on laws in the expectation of realizing the normalization of market economy order.
