试论知识经济时代的知识产权法

On Intellectual Property Law of Intellectual Economy

知识经济作为新的经济形态,有着它特有的经济基础结构与法律制度体系,在法律制度体系中,知识产权法与科技、经济有着特殊的关系。近年来,为适应加入WTO的要求和履行TRIPS有关规定,我国不断加大知识产权保护的力度。分析了知识经济时代我国知识产权法的发展现状以及完善知识产权法需要注意的一些问题,旨在引起更为广泛的思考。

As a kind of economic form, intellectual economy has especial economic structure and legal system. There is special relationship among property rights, science and economy. Recently China strengthens the protection to intellectual property continuously to meet the requirement of accession to WTO and perform the provision of TRIPS. The article analyses the status of China intellectual property,studies some problems in need of attention to perfect intellectual property in order to arouse a wider think.
