Brief Discussion of the Circumstances in Discretion of Punishment

量刑情节与定罪情节相对应,属于一种犯罪情节,是指影响量刑结果的主客观事实情况,主要功能是可以决定宣告刑。量刑情节具有一定法定性与非法定性和独立性与复杂性的特征,可以分为法定情节与酌定情节、单功能情节与多功能情节和应当情节与可以情节。量刑情节的适用较为复杂,总的原则是依法适用,同时应注意其存在的问题,并建议通过立法予以解决。

Circumstances in discretion of punishment refers to the facts which can influence the result of punishment. It has a mix character of legitimacy and nonlegitimacy, independence and complexity. The applicability of circumstance in dicrection is rather complicated, and the main principle is to apply it legally with a consideration of its existing problems.
