Interaction and Communication: Constitutional Law and Folk Law in China’s Linguistic Context

对处在法治进程中的中国来说,民间法是否还有存在的基础?我们应如何看待民间法?国家——社会二元结构的形成为民间法提供了存在的社会条件,大传统与小传统的阻隔又为民间法的存在与继续发挥作用提供了文化土壤。在处理二者关系上,不是一方对另一方的挤压与消灭,而是在相互尊重的基础上进行理性的对话与沟通。

The binary structure of Country — society has offered the social condition storing in to folk law, separating of big tradition and small traditional has offered the cultural background for existence and sustainable development of the folk law. In dealing with the relation, it is not extrusion and elimination of one party to another party. We should carry on the rational dialogue and communicate on the basis of respecting each other.
